Copyright Terms & Print Release Guidelines
Session fees cover the photographer’s time, detailed editing of appropriate images, maintaining the online galleries and processing of orders. Applicable deposits are due at the time of scheduling to confirm and reserve your date. Any balance of your session fee is due prior to the beginning of the session. See your wedding contract for deposit info.
The clients online web gallery will be active within two weeks of the session and is only available free for 30 days. The client will have a 30 day period to place orders from the gallery or pay a $25 fee to have the gallery re-hosted.
The print prices at the time of your booking are guaranteed for the duration of your allotted gallery time (30 days). In the event your gallery expires without you placing an order, there will be a $25 fee to renew it. Once a gallery is re-hosted after expiration, it will be subject to the current rates at the time of gallery renewal. Please make every effort to place orders in a timely fashion. In the interest of fairness to all of my clients, print prices are non-negotiable.
PayPal or Credit Card payments are recommended. There will be a 10 day processing time for any personal checks rendered as payment for services. We accept corporate, computer generated checks for commercial work. Please make checks payable to Tom Carr. A processing and handling fee of $25 will be applied for insufficient funds.
Reproduction of images without express consent from the photographer is unlawful and strictly prohibited. Scanning, screen capturing, editing or altering the images, selling, and printing of images are all considered copyright infringement.
Tom Carr Photography retains the copyright and ownership of all images created during the portrait session and has the right to make reproductions of images for commercial use and promotional purposes. By agreeing to these terms, the client hereby releases Tom Carr Photography from all claims and liability relating to said photographs.
Tom Carr Photography provides each customer unlimited printing rights to the purchased digital images for personal (non-commercial) use. Tom Carr Photography claims a “Right of Restraint” to prohibit the use of images commissioned for printing to be used for commercial purposes without prior written agreement. The customer acknowledges that the copyright is owned by Tom Carr Photography and subsequent use will be as agreed. It does not include rights to edit or alter the image, sell them, etc. That right remains with the copyright owner/photographer. Requests for commercial use of photographs are to be submitted for approval and an additional fee will be required. A Print Release Form is provided with all digital images.
The client gives consent to allow images to be used for promotional purposes for Tom Carr Photography. Such uses include but are not limited to display on website, blog, printed materials, portfolio samples, wall displays, and print competitions. The client may request images not be used on social media sites only.
